SMS Messaging Consent

This page describes how residents and contacts give consent to receive SMS text messages through the Modern Management property management platform, and the terms of that messaging program.

Program Description

Modern Management is a property management software platform used by property managers and landlords to communicate with their residents, vendors, and business contacts. Through this platform, property managers may send SMS text messages to residents and other contacts for the following purposes:

Consent is Mandatory

SMS consent is a mandatory requirement for receiving any text messages through Modern Management. No messages are ever sent to any phone number without prior, express written consent from the recipient. Consent must be obtained before any SMS communication can occur — this is enforced at both the platform level and the property-manager level.

Opt-In Workflow

The following workflow describes exactly how Modern Management captures SMS consent from every resident before their phone number is added to the system:

  1. Presentation: The resident is presented with the SMS Communication Authorization form — either as part of their lease agreement signing package (physical or electronic), or during resident onboarding after move-in is completed.
  2. Review: The resident reviews the full consent language, including the purposes of messaging, frequency expectations, opt-out instructions, and the fact that consent is not a condition of the rental itself.
  3. Affirmative Action: The resident must actively check the required consent checkbox. The box is never pre-checked by the property manager, staff, or the Modern Management platform.
  4. Signature: The resident prints their name, signs, and dates the form.
  5. Collection: The signed form is retained by the property manager in the resident's file as written proof of consent.
  6. Entry: Only after the signed form is received and stored does the property manager enter the resident's phone number into Modern Management.
  7. First Contact: The first SMS sent to the resident includes opt-out instructions (STOP to unsubscribe).

No phone number is entered into Modern Management without a completed, signed, dated consent form on file. No SMS is ever sent to a phone number that has not completed this workflow.

Opt-In Form — Verbatim Example

Below is the exact opt-in form used to capture SMS consent from every resident. The form is presented during lease execution or resident onboarding. The required consent checkbox is unchecked by default — the resident must actively check it before the form can be submitted. The form is never pre-filled, pre-checked, or submitted on the resident's behalf.

This is a visual representation of the actual opt-in form used. The real form is printed as part of the lease agreement packet or presented during resident onboarding.

How Consent is Obtained

Residents and contacts are required to provide explicit written consent to receive SMS messages before any messages can be sent to their phone number. Consent is collected through one or more of the following mandatory processes:

Consent is not optional. No phone number is ever entered into Modern Management without the contact's prior, express written consent to be reached via SMS at that number. Property managers using this platform agree to our Terms of Service, which strictly require them to obtain and document express written consent before adding any contact's phone number to the system. Failure to obtain consent before sending messages is a violation of our Terms of Service and may result in account suspension.

Message Frequency

Message frequency varies depending on the recipient's relationship with the property and circumstances. Typical recipients receive 1–10 messages per month. During periods such as lease renewal, emergencies, or active maintenance issues, message volume may be higher.

Message and Data Rates

Message and data rates may apply depending on your mobile carrier and plan. Modern Management does not charge you for messages, but your carrier may. Contact your mobile carrier for details.

How to Opt Out (STOP)

You can stop receiving SMS messages at any time by replying STOP to any message. You will receive one final confirmation message, after which no further messages will be sent to your number. You may also contact your property manager directly to be removed from SMS communications.

Privacy

Phone numbers collected by property managers using Modern Management are used solely for the property-management communication purposes described above. Numbers are never sold, shared with third parties for marketing, or used for promotional messaging outside of the direct property-management relationship. Supported Carriers

SMS messages are supported on all major U.S. carriers, including AT&T, Verizon, T-Mobile, Sprint, and most regional carriers. Carriers are not liable for delayed or undelivered messages.
